Contract of Employment (permanent, temporary or limited duration) UNYEZI RECRUITMENT PERMANENT PLACEMENT & EXECUTIVE SEARCH FEE, GURANTEES, AND TERMS OF SERVICE The charge rate or fee for permanent placements is calculated on the basis of a percentage of the employee's total annual package (we discuss this in detail with you the client). Fees arise and become due for payment when the candidate introduced by Unyezi Business Consultants cc commences employment in any capacity (whether as an individual or other legal entity) either temporary or permanent with our client. Alternatively any other party to whom client introduces the candidate within six months of the last date of referral. An invoice will be issued on the date the candidate commences employment and our payment terms are 7 (seven) days from date of invoice. Unyezi Business Consultants cc reserves the right to charge interest at the maximum rate in terms of the Usury Act on late payments. Engagement of a candidate referred by Unyezi will be deemed to be an acceptance of our terms. The fee is based on the full annual remuneration package offered to the prospective candidate irrespective of how the package is structured. The fee is payable by the employer and no charge is made to jobseekers. If a Client places a position or vacancy with Unyezi Recruitment or actively recruits an employee referred by Unyezi, the Client shall be liable to pay Unyezi the full placement fee. No variations shall be made to these Terms and Fees without the written consent of a duly authorized consultant or member of Unyezi Recruitment (Unyezi Business Consultants cc). GUARANTEE Unyezi Business Consultants cc offers a three-month Guarantee subject to the Guarantee being validated. The Guarantee is validated by the full fee being paid within 14 (fourteen) days of the candidate commencing employment. Should an employee be hired on the recommendation of Unyezi Business Consultants cc leave for any reason within the Guarantee period, subject to the terms and conditions of the Guarantee below, Unyezi Business Consultants cc will provide replacement candidates. Terms and Conditions of Guarantee: 1. Replacement: If the Guarantee is validated and if the first person engaged leaves within the Guarantee period, the Client is entitled to receive replacement candidates at no additional cost. 2. Rebates: In the event that none of the replacement candidates prove suitable for engagement, or should the Client not require a replacement, providing the original candidate has left, the Client will qualify for a rebate. If the candidate leaves within the first month of employment, a 75% rebate of the placement fee will be credited. A 50% rebate will apply if the candidate leaves within the second month and a 25% rebate if in the third month. If the Client does not qualify for the Guarantee, full payment of the fee will be required. 3. If the Client does not validate the Guarantee, even if the candidate leaves the Client's employ within the Guarantee period, the Client will not be entitled to receive replacement candidates or a rebate. The Client will be liable for the total amount due on the original invoice. 4. Requests for replacements or rebates must be made to Unyezi Business Consultants cc within 48 hours of the last date of employment, and must specify the date the original person placed actually left, or will leave, the Client's employment. Temp-To-Perm Placement Fee Where the client wishes to engage the services of a Temporary Employee supplied by Unyezi Business Consultants cc in a permanent capacity, the permanent placement fee will be based on the employee’s annual package less the number of completed months the Employee was engaged on a temporary basis by the Client. That is the placement fee shall be reduced by the amount of 1/12th for every completed month worked by the candidate at the Client, whilst in the employ of Unyezi Business Consultants cc. In the case of a Temp-To-Perm-Placement Fee, the 3-month guarantee shall not be applicable. If the client wishes to engage the services of a Temporary Employee supplied by Unyezi Business Consultants cc in a permanent capacity after the Temporary Employee has completed 1 year service at the Client, no permanent placement fee shall be charged to the client. References All references are forwarded on a strictly confidential basis and should not be discussed with the candidate. Backrgound Checks Unyezi performs background checks as part of our recruitment for all candidates that we send to our clients. These include: Pre- employment screening Criminal record check Qualification verification
